8. Payments made by Credit Card will be repaid to the same Credit Card if the Cancellation Plan is paid out.
CHANGING YOUR HOLIDAY
9. If you wish to make a change to your confirmed booking, you should telephone our Customer Care Dept. on 0870 541 1411 or contact your travel agent. Requests made by telephone must be confirmed in writing. We will try to meet your new requirements but this will be subject to the availability of your chosen accommodation. Each time a confirmed booking is amended, the total price of the booking will be recalculated and will also be subject to an administration charge of £20. This will be advised to you at the time you request the change to your booking. There is a minimum of 14 days notice required prior to your holiday start date.
IF WE CHANGE OR CANCEL YOUR HOLIDAY
10. We reserve the right to change or cancel your confirmed booking at any time before the start of your holiday because due to unforeseen circumstances the accommodation or Park that you have chosen for your holiday dates is not available:
10.1. Offer you at no extra cost an alternative holiday or accommodation of the same or higher standard or allow you at your option to cancel your holiday with a full refund of all monies paid:
10.2. And unless our change or cancellation to your confirmed booking is due to circumstances which are beyond our reasonable control pay you compensation at the following rates depending on the number of days we inform you of the need to make a change or cancel your holiday before it is due to commence. 0 - 14 days: £40 per week or £20 per short break. 15 days or more: £20 per week or £10 per short break. The above compensation will be paid in respect of each accommodation unit booked.
LIMITATIONS AND EXCLUSIONS OF OUR LIABILITY
11. Nothing in these booking conditions (a) excludes or limits our liability for death or personal injury suffered by you and your holiday party which results from our negligence or (b) affects your statutory rights.
12. We will not be liable for any failure or delay in performing our obligations under the contract if such delay or failure is due to circumstances which are beyond our reasonable control, but if such circumstances arise we will take all requisite steps, so far as is reasonably practicable, to comply with our obligations.
LIABILITIES
13. Whilst we believe we take all reasonable precautions consistent with our responsibilities as Holiday Park operators, we will under no circumstances be liable for any injury, loss or damage suffered by you, any member of your party, your personal belongings or any property of members of your party. Therefore customers and their property come to our holiday parks and use the facilities at their own risk.
ARRIVAL AND DEPARTURE TIMES
14. Please see the Caravan description on pages 8 and 9 of our brochure or visit the holiday home choice page for check-in times. All accommodation must be vacated by 10 a.m. on the day of your departure and the accommodation should be left clean and ready for incoming guests. If you are likely to arrive after 6 p.m., it is essential that you telephone the park in advance of your arrival so that we can make arrangements for you to collect your keys.
BOOKINGS BY YOUNG PERSONS/SINGLE SEX PARTIES
15. As British Holidays are intended for family holidays, we are unable to accept bookings from groups of young people, of mixed or single sex, under the age of 21 years or groups of single sex parties of any age. We retain the right to retain the keys for accommodation if this condition is contravened.
CONVENIENCE STORES
16. These are open daily during the high season in July and August from 9 a.m. until at least 6.30p.m. During April, May, June, September and October, the hours may be restricted.
SPECIAL REQUESTS
17. We will endeavour to meet your specific requests, but we are very sorry, they cannot be guaranteed.
DOGS, CATS AND OTHER PETS
18. Most dogs and cats are welcome in 3 Star or Bronze accommodation at the Manager's discretion and at a charge of £45 for each pet per week or £25 for each pet per part week (max. 2 pets per booking). Guide dogs are exempt from this charge. We reserve the right to require the owner of any dog or other pet to remove it from the park. Pets are not allowed entry to Park facilities. Sorry, no pets allowed at Burnham-on-Sea Holiday Village.
CHILDREN
19. Facilities for children include the children's Bradley Bear Club and organised games and sports which have a special programme of events. Whilst we are happy to provide these and other facilities, please note they are not a child care facility and children will remain the responsibility of their parents/ guardians at all times.
HOLIDAY PRICES
20. The prices and charges in our brochure or in these booking conditions are inclusive of VAT (where applicable). We guarantee that once you have made your booking and paid a deposit we will not increase your holiday price unless you make a change to your booking, although we reserve the right to amend the VAT element of prices in the event of a change in the rate of VAT.
21. Certain caravans are not owned by us but are managed and let by us to holiday-makers on behalf of their owners who may not be registered for VAT. Where this is the case, the holiday price is not subject to VAT but includes an additional handling fee of 17.5% (inclusive of VAT) so that the final holiday price for similar accommodation is identical.
AVAILABILITY OF FACILITIES
22. Whilst we will endeavour to provide all facilities and entertainment events advertised in this brochure or elsewhere, we reserve the right to make changes to, or withdraw, those facilities and entertainment events should this be necessary due to any circumstances beyond our control, including by way of example only, the cancellation of an entertainment event by the entertainer, adverse weather conditions, repair, or maintenance. We reserve the right to make such alterations in the above circumstances without prior notice, and without any liability to pay you compensation or damages for the loss of an advertised facility or entertainment.
23. We reserve the right to alter the facilities and services we wish to provide should this be necessary to follow guidelines issued by the Health and Safety Executive, and Safety Executive, Local Authorities and Codes of Practice.
24. Certain facilities listed in this brochure are subject to an additional cost and please note off peak facilities may be reduced or restricted. Facilities at the Park maybe subject to a refundable booking deposit. You are welcome to use your own sports equipment, but equipment can be hired from the Park at a nominal charge. Parks which list fishing as a facility require a rod license, and additional charges where applicable.
VENUES
25. Due to space restrictions and licensing laws, some facilities have age restrictions covering certain times. At Burnham on Sea, during school holidays children under 14 years may be restricted to one venue.
FUNWORKS PASSES
26. All holidaymakers names are registered at the Club on the park. If you wish to join, it is to your advantage to pay for your passes in advance as passes paid in advance are £1 cheaper per pass than passes paid for on arrival. The prices of passes paid in advance are indicated throughout this brochure for each particular park. Provided you have paid for your passes in full before the start of your holiday, you can collect your passes from reception on arrival. Your weekly pass entitles you to use the swimming pools, participate in the Bradley Bear Club, leisure and use of the entertainment facilities and coarse fishing lakes. Off peak Funworks Passes for Spring and Autumn, include reduced entertainment and restricted facilities and are therefore offered at a reduced rate. Note: the Local Club Licensing Laws are such that members names and addresses must be registered a minimum of 48 hours in advance.
COMMENTS AND COMPLAINTS
27. If you feel that you have any comments or complaints whilst on holiday, you should contact the Park¹s reception or Customers Service Representatives at the Park during your stay so that we can try to resolve any problems as soon as possible. If your complaint is not resolved whilst you are on holiday, please write to our Central Customer Services Manager, British Holidays,1 Park Lane, Hemel Hempstead, Herts, HP2 4YL, within 14 days of returning from your holiday, stating your holiday reference number.
GENERAL
28. We wish to give you time to consider whether these booking conditions are acceptable to you. If you have not had the opportunity to read these booking conditions before making your booking and these booking conditions are not acceptable to you, you may cancel your booking without charge and we will refund all monies paid to us, provided you do so in writing within 7 days of the date of our written confirmation of your booking, and before your holiday start date. If you do not inform us of your wish to cancel within 7 days from the date of our written confirmation, and before your holiday start date, the contract between us incorporating these booking conditions will remain in full force and effect.
29. In these booking conditions 'you¹ and 'your¹ refers to the person who signs the booking form; 'we¹, 'us¹ and 'our¹ refers to British Holidays (a trading division of Bourne Leisure Limited of 1 Park Lane, Hemel Hempstead, Hertfordshire HP2 4YL); 'holiday party¹ refers to those persons named on the booking form and any person added to the booking at a later date; the 'Park¹ means the Holiday Park you have chosen for your holiday.
